This flag is also of the Gadsden theme, but was used at sea. It became known as the first flag of the Continental Navy. It carried Gadsden's warning, "Don't Tread on Me" but with a sea snake slithering across a 13 red-and-white striped field.

This flag is also of the Gadsden rattlesnake and, "Don't Tread on Me" theme, but also bore the slogan, "Liberty or Death". This particular variant was called the "Culpepper" or "Culpeper" Flag. It reportedly was first used as the banner for a group of about one hundred minutemen in Culpeper County, VA who formed part of Colonel Patrick Henry's First Virginia Regiment of 1775.

Created by Colonel Gadsden of the American Revolutionary Army, the Gadsden flag consisted of a yellow field with a rattlesnake in a spiral coil, poised to strike, in the center. This flag was carried by Colonel William Moultrie's South Carolina Militia on Sullivan Island in Charleston Harbor on June 28, 1776.
